Costco employee who wanted to bring dog to work loses appeal

Costco Wholesale Corp. Victory in a former employee’s lawsuit for bias over the alleged denial of his request to use his work dog to help with his anxiety issues has been upheld by the Ninth Circuit.

Nicholas Conlan’s health care provider sent Costco a memo that cleared Conlan to return to work without any medical restrictions, the court heard.

He argued that the note was ambiguous and that Costco should have consulted with the supplier before denying his request. But a lower court made no manifest error in finding otherwise, the United States Court of Appeals for the Ninth Circuit said…
